1. GENERAL
A. No order, whether resulting from a quotation or not, shall be deemed to or shall constitute a contract between us unless confirmed by us on our official acceptance form.
B. Any acceptance, by us of order, is subject to the following terms and conditions if yours official order form contains special printed conditions. It is understood that such conditions are only accepted in so far as they are not a variance with our terms and conditions.
2. QUOTATIONS
Quotations are submitted and orders accepted on the understanding that the company has the option to make the variation up to 10% in the quantity of any reference number ordered, the total amount payable by you being increased or decreased proportionately.
3. DELIVERY
All prices are set for New Delhi (India) unless otherwise agreed.
4. TIME FOR DELIVERY
Time of delivery is not guaranteed and we reserve the right to extend the time as may be reasonable if execution of contract is hindered or delayed by your instructions or lack of instructions or by any causes of any nature whatsoever is beyond our responsible control.
5. PAYMENT
Unless otherwise agreed, payment for all goods dispatched shall be net cash delivery of documents against payment through scheduled bank.
6. DIES PATTERN ETC
All dies, patterns and tools whether part cost be quoted or otherwise or included in the price of goods sold, remain our property, unless otherwise arranged. We will preserve these for a reasonable time in anticipation of future orders, but without any liability on our part.
7. SAMPLES
We cannot be responsible for the custody of customer’s samples, drawings etc. which will not be returned unless requested.
8. PACKAGES
Unless otherwise agreed packing and forwarding shall be charged at cost. Packaging charges are included unless any specific customization is requested, will be charged accordingly.
9. WARRANTIES
All goods are supplied on the condition that we shall not be liable for any loss incurred through stoppages not for any consequential loss.
10. GURANTEE
Our products are guaranteed by us free from all defects in materials used and defects in manufacture, except as otherwise stated in these conditions. We accept no responsibility, however, for consequential loss or damage. No for any defect or damage arising from failure or neglect to comply with our notes on storage and fitting.
11. DESCRIPTIVE MATTER
All descriptive matter, specifications, drawings, particulars of weight, dimensions and other information contained in our catalogue are believed to be accurate; but no accuracy of any information contained therein.
12. RETURNS
Goods once sold will not be returned.
13. PRICE LIST
The possession of our prices lists is not be constructed as an offer to sell the goods listed therein. The right is reserved to cancel any item without notice. Every care is taken in the preparation of our price lists, but no responsibility can be accepted for errors.
14. LAW GOVERNING CONTRACTS
Unless otherwise expressly stated all contracts shall be construed in accordance with and the performance thereof governed by Indian law.
15. RUSTING STEEL/RUBBER OF STEEL/FELT OIL SEALS
Every precaution is taken to prevent corrosion and rusting. In these circumstances we regret cannot hold ourselves responsible for rusting. To obviate rusting, we recommend that as far as possible these oil seals be stored in dry atmosphere. No claims for rusting can be entertained.
16. PACKING
Oil Seals packed in tens, and multiples thereof.
17. DISPUTES
Any dispute arising shall be within the jurisdiction of Delhi court.
18. GOVT. LEVIES
Excise duty and other government taxes are payable extra where ever applicable.
19. DEALERS SELLING
Dealers can sell the goods at a price lower than the list prices.
